You remain responsible for the accuracy, legality, security, and ownership of any materials you provide.

Unless we have signed a separate written agreement stating otherwise, submitting information through the Site does not create a confidential, fiduciary, professional, or client relationship with B3NET.

6. Professional Services and Separate Agreements

The information on the Site is provided for general informational and marketing purposes. It does not create a binding obligation for B3NET to provide any service, deliverable, timeline, price, result, or support unless confirmed through an online plan purchase, invoice, proposal, statement of work, service agreement, or other written approval.

B3NET’s professional services may include website design, website development, ecommerce development, WordPress development, Shopify development, Magento development, mobile app development, SEO, PPC management, social media marketing, email marketing, content marketing, AI integration, chatbot development, marketing automation, Zoho consulting, CRM automation, website maintenance, hosting support, security monitoring, performance optimization, and related digital services.

Any paid service provided by B3NET may be subject to a separate proposal, invoice, statement of work, service agreement, contract, online plan description, or written approval.

If there is a conflict between these Terms and a signed service agreement, the signed service agreement will control for the specific services covered by that agreement.

7. Website Maintenance Plans

B3NET may offer website maintenance plans through maintenance.b3net.com or other B3NET-owned pages. These plans may include services such as website updates, security monitoring, malware scanning, uptime monitoring, performance optimization, content edits, backup support, server support, software updates, plugin updates, theme updates, troubleshooting, and other related support services.

The exact features, limits, response times, monthly hours, included services, excluded services, pricing, billing frequency, and support level for each plan are described on the applicable plan page, checkout page, proposal, invoice, or written agreement.

By selecting a website maintenance plan, you acknowledge that:

  • Your selected plan determines the included services and service limits.
  • Some requests may be outside the scope of the selected plan and may require a separate quote or approval.
  • Unused monthly service hours, if any, do not automatically roll over unless expressly stated in writing.
  • Response times are estimates unless expressly guaranteed in a separate written agreement.
  • Emergency requests, complex development work, redesign work, major functionality changes, hosting migration, malware cleanup, custom coding, third-party plugin conflicts, server issues, and advanced troubleshooting may require additional fees unless included in the selected plan.
  • B3NET may require website access, hosting access, CMS access, plugin access, DNS access, payment approval, or other cooperation from you to perform services.
  • Delays caused by missing access, third-party systems, unpaid invoices, client approvals, hosting providers, plugin vendors, or platform limitations are not the responsibility of B3NET.

B3NET reserves the right to modify, replace, suspend, or discontinue maintenance plans at any time. Changes to existing active subscriptions will be handled according to the applicable plan terms, written agreement, or notice provided to the customer.

8. Subscription Billing and Recurring Payments

Some services, including website maintenance plans, may be billed on a recurring basis, such as monthly, quarterly, annually, or according to another billing frequency shown at checkout or stated in a written agreement.

By purchasing a recurring plan or subscription, you authorize B3NET and/or its third-party payment processor to charge your selected payment method for the applicable recurring fees, taxes, processing fees, upgrades, add-ons, approved service charges, and other amounts due according to the selected plan, checkout page, invoice, proposal, or written agreement.

Recurring payments may continue until the subscription is canceled, expired, terminated, replaced, or otherwise ended according to the applicable terms.

You are responsible for keeping your billing information, payment method, email address, and account information accurate and up to date.

If a recurring payment fails, B3NET or its payment processor may retry the payment, send payment reminders, suspend services, downgrade services, pause support, or terminate the subscription where appropriate.

B3NET is not responsible for service interruptions caused by failed payments, expired payment methods, declined cards, incorrect billing information, chargebacks, payment processor issues, or delayed customer action.

9. Third-Party Payment Gateways and Payment Links

B3NET may use third-party payment gateways, payment processors, invoicing platforms, customer portals, subscription billing tools, or payment links to collect payments for services.

When you click a payment link or complete a payment through a third-party gateway, your payment information may be collected and processed directly by that third party. Your use of that payment gateway is subject to the third party’s terms, privacy policy, security practices, and processing rules.

B3NET does not control third-party payment gateways and is not responsible for their availability, processing delays, security incidents, technical errors, declined transactions, payment holds, account reviews, or platform decisions.

B3NET may receive limited payment-related information from the payment processor, such as payment confirmation, transaction ID, subscription status, customer ID, invoice ID, payment token, card brand, last four digits, and expiration month/year, where made available by the provider.

You should submit payment information only through approved secure payment links, invoices, customer portals, or payment methods provided by B3NET. Do not send credit card numbers, card security codes, bank details, or other sensitive payment information by email, chatbot, general contact form, or unsecured message.

10. Cancellations, Plan Changes, and Refunds

Cancellation, plan change, renewal, and refund rules may vary depending on the service, plan, proposal, invoice, payment link, or written agreement.

Unless otherwise stated in a specific plan, invoice, proposal, or written agreement:

  • You may request cancellation by contacting B3NET using the contact information provided below.
  • Cancellation requests should be submitted before the next billing date to avoid future recurring charges.
  • Already-paid fees are generally not automatically refundable once a billing period has started, unless required by law or approved by B3NET in writing.
  • B3NET may decline refunds for work already performed, time reserved, third-party costs, software subscriptions, hosting costs, setup fees, onboarding fees, transaction fees, emergency support, or completed service periods.
  • Plan upgrades may take effect immediately or at the next billing cycle depending on the circumstances.
  • Plan downgrades may take effect at the next billing cycle unless otherwise approved by B3NET.
  • If you cancel a maintenance plan, B3NET may stop monitoring, support, updates, backups, edits, security checks, and other services associated with that plan.
  • Cancellation of a payment subscription does not automatically cancel outstanding invoices, unpaid balances, or obligations for work already approved or performed.

B3NET reserves the right to cancel, suspend, or terminate a subscription for non-payment, abuse, security risk, violation of these Terms, violation of a service agreement, unsupported website conditions, or other reasonable business or legal reasons.

11. Client Responsibilities for Maintenance Services

For website maintenance, support, monitoring, or technical services, you agree to cooperate with B3NET and provide the access, information, approvals, and materials reasonably needed to perform the requested services.

You are responsible for:

  • Providing accurate website, hosting, CMS, DNS, domain, plugin, theme, and server access where needed.
  • Maintaining ownership and control of your domain, hosting, third-party accounts, licenses, plugins, themes, and subscriptions unless otherwise agreed.
  • Keeping paid third-party tools, plugins, themes, licenses, hosting accounts, and software subscriptions active.
  • Reviewing and approving changes, content, updates, or recommendations in a timely manner.
  • Backing up or preserving any information outside B3NET’s agreed scope of responsibility.
  • Ensuring that content, media, images, trademarks, data, and materials you provide are legally permitted for use.
  • Notifying B3NET of known website issues, unauthorized access, malware warnings, hosting notices, or third-party platform alerts.
  • Understanding that some issues may be caused by third-party hosting, plugins, themes, APIs, integrations, payment platforms, or software vendors outside B3NET’s control.

B3NET is not responsible for delays, errors, downtime, data loss, security issues, or service limitations caused by missing access, incorrect information, third-party tools, unsupported software, expired licenses, hosting issues, client-side changes, unauthorized third-party changes, or circumstances outside B3NET’s reasonable control.

12. No Guarantee of Results

B3NET works to provide professional, practical, and results-focused digital services. However, we do not guarantee any specific business, marketing, technical, financial, ranking, traffic, conversion, lead generation, advertising, revenue, uptime, security, performance, or maintenance result unless expressly stated in a signed written agreement.

You understand that results may vary based on many factors, including market conditions, competition, advertising budget, website history, search engine algorithms, platform policies, technical limitations, client responsiveness, content quality, hosting environment, plugin quality, theme quality, third-party systems, and industry trends.

B3NET does not guarantee:

  • First-page Google rankings.
  • Specific SEO rankings or traffic levels.
  • Specific PPC cost-per-click, conversion rate, or return on ad spend.
  • Specific sales, leads, revenue, or profit.
  • Approval by Google, Meta, LinkedIn, Amazon, app stores, payment processors, or other third-party platforms.
  • Continuous website uptime.
  • Complete prevention of hacking, malware, spam, downtime, plugin conflicts, or security incidents.
  • That all third-party plugins, themes, hosting tools, APIs, payment gateways, or integrations will continue to function without interruption.
  • That AI-generated, automated, or marketing content will always be accurate, complete, compliant, or suitable for every use case.

Any examples, testimonials, case studies, statistics, or performance references on the Site are provided for informational purposes and do not guarantee that you will achieve the same or similar results.

13. Artificial Intelligence (AI) Disclaimer

The Site may use AI-powered tools, automated systems, chatbots, recommendation tools, content assistance tools, or similar technologies to support communication, lead capture, customer service, marketing, and general information delivery.

By using these features, you acknowledge that you may be interacting with an automated system and not a human representative. AI-generated responses are provided for general informational purposes only and may not always be accurate, complete, current, or suitable for your specific situation.

You should not submit sensitive, confidential, regulated, or highly personal information through AI tools, chatbot features, or general website forms unless B3NET has specifically provided a secure method and a written agreement applies.

We may monitor, review, store, or analyze chatbot and automated tool interactions for quality assurance, training, lead management, security, compliance, and service improvement purposes, as described in our Privacy Policy.

14. Marketing Communications

Even if you unsubscribe from marketing communications, we may still send transactional, administrative, billing, subscription, payment, project-related, security, or service-related communications where appropriate.

You agree not to provide false contact information or use another person’s contact information without permission.

15. Portfolio, Testimonials, and Case Studies

B3NET may display examples of its work, project summaries, testimonials, screenshots, client names, logos, case studies, performance examples, or portfolio items on the Site or in marketing materials where permitted by the client, applicable agreement, or law.

If a client has specific confidentiality, brand, or non-disclosure requirements, those requirements should be included in a separate written agreement with B3NET.

B3NET reserves the right to describe its general services, experience, industries served, and project capabilities without disclosing confidential client information.

16. Third-Party Links, Tools, and Integrations

The Site may contain links to third-party websites, platforms, applications, tools, plugins, payment processors, payment gateways, customer portals, analytics tools, social media platforms, scheduling tools, CRM systems, chatbot providers, advertising networks, embedded content, or other services not owned or controlled by B3NET.

B3NET is not responsible for the content, accuracy, availability, security, policies, terms, privacy practices, or actions of third-party websites or services.

Your use of third-party websites, platforms, tools, payment gateways, or integrations is subject to the terms and policies of those third parties. You should review their terms and privacy policies before using them or submitting personal or payment information.

Third-party links or integrations do not imply endorsement, sponsorship, partnership, or responsibility unless expressly stated in writing by B3NET.

B3NET may update, modify, remove, or discontinue any Site content, feature, page, plan, price, service description, payment link, form, chatbot feature, or resource at any time without notice.

The information on the Site should not be relied upon as professional, legal, financial, tax, technical, or business advice. You should contact B3NET directly to confirm details before making decisions based on Site content.
